Terms of use

These terms apply to the Ophanim AI OS at app.ophanimai.com, provided by Josef Volpin, sole trader trading as “Ophanim AI”, Via C. Beccaria 14, 35125 Padua (PD), Italy, VAT no. 05775320285. A client’s written agreement with Ophanim AI governs the service; these terms add the rules for its Instagram features, and prevail on those features if the two differ.

1. Who may use it

The OS is for businesses and professionals, used through an account their workspace was given. Connecting an Instagram account requires a professional (Business or Creator) account that you own or are authorised to manage.

2. What the Instagram features do

With your permission, given when you connect the account and revocable at any time, the OS reads the comments on your posts and the messages your account receives, and sends the replies you set up: a private reply to a person who commented with your keyword, a public reply under their comment, and the messages that follow when they answer. You decide the keywords, the texts and the links.

3. Your responsibilities

  • You follow Meta’s Platform Terms, Instagram’s Terms of Use and Community Guidelines.
  • You only message people who commented on your post or wrote to your account, about what they asked for. No unsolicited, misleading or unlawful messages, and no links to anything harmful.
  • You are responsible for your content, your offers and the links you send, and, as controller, for having a lawful basis for the personal data of the people who contact you, including telling them how you use it.
  • You keep your OS login safe and tell us at once if you think someone else has used it.

4. What we may do

To protect your account and Instagram’s rules, the OS respects Instagram’s limits: one private reply per comment, within seven days of it, and further messages only within 24 hours of the person’s last message. We may pause sending from an account that receives errors from Instagram or appears to be misused, and we will tell you why.

5. Instagram is Meta’s

These features depend on Meta’s services and permissions, which Meta may change, limit or withdraw. We will adapt where we can, but we cannot guarantee that a feature keeps working if Meta changes it, and we are not responsible for decisions Meta takes about your Instagram account.

6. Ending it

You can disconnect your Instagram account in the OS, or remove Ophanim AI from Instagram’s settings (Settings, Apps and websites), at any time; sending stops at once. To have the data deleted too, see Delete your data.

7. Liability and law

Our liability is as set out in your agreement with Ophanim AI. These terms are governed by Italian law, and the courts of Padua have jurisdiction, unless a mandatory rule says otherwise.
